TERMS OF SERVICE

By creating an account or using Sample Everything™ at sample-everything.com you agree to these Terms of Service. If you do not agree do not use the service. These terms form a legally binding agreement between you and Sample Everything™.

Sample Everything™ is a web-based tool that allows users to upload video and audio files, extract audio from them, and generate sample packs including one-shots and loops for use in music production.

We provide the tool. We do not create, own, moderate, or take responsibility for the content of any sample packs created by users of the tool.

This is the most important section of these terms. Read it carefully.

Sample Everything™ is a tool. Nothing more. We provide the technology that allows you to extract audio from video and audio files you upload. We do not:

• —Select, curate, or approve the content you upload
• —Review or monitor what you upload
• —Create sample packs on your behalf
• —Clear, license, or verify the copyright status of any audio you extract
• —Take any responsibility for what you do with the samples you create
• —Guarantee that sounds you extract are cleared for commercial use

The sample packs you create using Sample Everything™ are entirely your creation. You are the creator. You bear full and sole responsibility for every sound in every pack you make.

Sample Everything™ is the pen. You are the writer. We are not responsible for what you write.

You are solely and entirely responsible for every file you upload to Sample Everything™ and every sample pack you generate.

By uploading a file you confirm that:

• —You own the file or have explicit permission from the owner to use it
• —The file does not infringe the copyright, trademark, or intellectual property rights of any third party
• —You have the legal right to extract audio from this file and use it in your work
• —The file does not contain illegal content
• —You are not uploading content from a source that prohibits extraction or reproduction of its audio

Sample Everything™ provides a tool. What you do with that tool is your responsibility and your responsibility alone.

If you upload a video you do not own — a clip downloaded from YouTube, Instagram, TikTok, Spotify, or any other platform — and the audio in that video is protected by copyright, you are solely responsible for any legal consequences that arise.

We do not monitor what you upload. We do not verify ownership. We do not clear samples on your behalf. You are the creator of your sample packs and you bear full legal responsibility for what those packs contain and how you use them.

If you are unsure whether a sound is cleared for use — do not use it.

Sample Everything™ accepts no liability whatsoever for copyright infringement claims arising from content you upload or sample packs you create using our tool.

Many platforms including YouTube, Instagram, TikTok, Spotify, and SoundCloud prohibit the downloading or extraction of audio from their content in their own terms of service. Violating those platform terms is your responsibility. Sample Everything™ is not liable for your use of third party platform content.

You retain full ownership of the original files you upload. You retain full ownership of the sample packs you generate from content you legally own or have the right to use.

We do not claim any ownership over your uploads or your generated packs.

We do not use your uploaded audio for training machine learning models or any purpose other than providing you with the service.

Sounds obtained through Sample Everything™ — whether downloaded from HEARD, FINDS, the Marketplace, or generated via the platform — may be used in your own creative and commercial works. You may not:

• —Resell, sublicense, or redistribute individual sounds or packs as standalone products outside Sample Everything™
• —Use Sample Everything™ content to build, populate, or operate a competing sound library, sample marketplace, or similar platform

Sample Everything™, its design, user interface, branding, logo, name, tagline, and all associated visual identity are the intellectual property of Sample Everything™. All rights reserved.

The audio processing methodology, algorithms, and technical systems used by Sample Everything™ are proprietary and confidential.

The following are strictly prohibited:

• —Reverse engineering or decompiling any part of the platform
• —Scraping or systematically querying the API by automated means
• —Reproducing or replicating the processing logic or methodology
• —Reselling or sublicensing access without written permission
• —Using the service to build a competing product

You must be at least 18 years old to use Sample Everything™. By creating an account you confirm you are 18 or older.

You are responsible for keeping your login credentials secure. You are responsible for all activity under your account. Do not share your account with others.

Free plan: Provided as-is with usage limits as described on the pricing page. Limits may change with reasonable notice.

Paid plans: Billed monthly on your billing date. Payments processed by Stripe. By subscribing you authorise recurring charges.

Cancellation: Cancel any time from account settings. Access continues until end of billing period. No partial refunds on monthly plans.

Refunds: No refunds on monthly subscription payments. Charges in error — contact us within 7 days at hello@sample-everything.com.

Price changes: We may change prices with 30 days notice. Continued use after price change constitutes acceptance.

Credits are consumed when you export audio files. One-shots cost 1 credit. Loops and sequencer patterns cost 2 credits. Credits reset monthly. Unused credits do not roll over. Credits have no cash value and cannot be refunded.

Free + Starter: Source videos deleted 24 hours after export or upload.

Pro: Source videos deleted 7 days after export or upload.

World: Source videos deleted 30 days after export or upload.

On account deletion: All data permanently deleted within 30 days.

We are not responsible for loss of data. Download and store your own copies of any packs you wish to keep permanently.

You may not use Sample Everything™ to:

• —Upload content that infringes any third party intellectual property rights
• —Upload illegal, harmful, or abusive content
• —Attempt to gain unauthorised access to any part of the service
• —Use the service for any unlawful purpose
• —Upload malware or harmful code
• —Impersonate any person or organisation

Sample Everything™ is provided as-is without warranty of any kind. We do not warrant that the service will be error-free, uninterrupted, or suitable for any particular purpose.

We make no warranty about the legal clearance of any sample you generate. Copyright clearance is entirely your responsibility.

To the maximum extent permitted by law Sample Everything™ shall not be liable for any indirect, incidental, or consequential damages arising from your use of the service including but not limited to:

• —Copyright infringement claims arising from content you upload or packs you create
• —Loss of data or content
• —Revenue or profit loss

Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

You agree to indemnify and hold harmless Sample Everything™ from any claims, damages, or expenses including legal fees arising from your use of the service, your violation of these terms, or your infringement of any third party rights.

We may suspend or terminate your account at any time for violation of these terms. On termination your access ends immediately and your data is deleted within 30 days.

These terms are governed by the laws of England and Wales. Disputes are subject to the exclusive jurisdiction of the courts of England and Wales.

We may update these terms at any time. We will notify you of material changes by email or in-app notice. Continued use after changes constitutes acceptance.
